At PrepDrive, we want you to be confident when purchasing our products. This Returns, Refunds & Warranty Policy explains when you may return a product, request a refund or replacement, and how we handle defective or damaged products.
This policy applies to purchases made through our online store and is intended to operate in accordance with applicable South African consumer-protection legislation, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").
Nothing in this policy is intended to limit, exclude or waive any consumer right that cannot legally be excluded.
1. Change-of-Mind Returns
If you purchase a product through our online store, you may have a statutory right to cancel the transaction without providing a reason, where the requirements of applicable South African law are met.
For qualifying electronic transactions, the ECTA provides a 7-day cooling-off period calculated from the date on which you receive the goods.
If you exercise a valid cooling-off right:

You must notify us within the applicable statutory period.

The product must be returned to us.
-
The direct cost of returning the product may be payable by you, where permitted by law.

The product should be returned in a condition that allows us to receive and inspect it.

Where the law requires a refund, we will process the refund in accordance with the applicable statutory requirements.
The ECTA provides that a consumer exercising the section 44 cooling-off right may be charged only the direct cost of returning the goods, and where payment has already been made, the refund is generally due within 30 days of cancellation.
The cooling-off right does not apply to every transaction. Certain statutory exclusions may apply.
2. Defective, Unsafe or Poor-Quality Products
Your statutory rights regarding defective or poor-quality goods are not affected by this policy.
Under section 56 of the CPA, goods supplied to a consumer carry an implied warranty of quality. Within six months after delivery, a consumer may return goods that fail to satisfy the applicable requirements of section 55, without penalty and at the supplier's risk and expense. Depending on the circumstances and applicable law, the consumer may be entitled to have the product repaired, replaced or refunded.
For a PrepDrive Portable Tyre Inflator, this may include situations where the product:

Is defective when received;
-
Does not function as reasonably expected;
-
Is unsafe;
-
Is materially different from the product described or ordered;
-
Is not reasonably suitable for its ordinary intended purpose; or
-
Otherwise fails to comply with applicable consumer-protection requirements.
We may ask for reasonable information, photographs or videos to help us understand the reported problem and determine the appropriate return procedure. This does not remove or restrict any statutory consumer right.
Where a product is returned under a valid statutory defect claim, we will handle the return in accordance with applicable law.
3. Damage Caused by Misuse or Incorrect Use
Our products must be used in accordance with the instructions, safety warnings and intended purpose supplied with the product.
A return, repair or replacement may not be available where a failure or damage was caused by circumstances outside the product's applicable warranty or statutory protection, including, where legally established:

Accidental damage;

Physical abuse or impact;
-
Water or liquid damage where the product is not designed to be waterproof;

Incorrect charging or use of an unsuitable charger or power source;

Use contrary to the supplied instructions;
-
Unauthorised modification or attempted repair;
-
Opening or dismantling the product;
-
Using the product for a purpose for which it was not designed;
-
Normal cosmetic wear and tear;
-
Damage caused by incorrect storage or handling; or
-
Damage occurring after delivery that was not caused by a defect in the product.
Nothing in this section limits a consumer's statutory rights where the law provides otherwise.
4. Product Used Before a Change-of-Mind Return
If you simply change your mind about your purchase, please avoid unnecessary use of the product before requesting a return.
Where a statutory cooling-off right applies, we will deal with the return in accordance with the applicable legislation.
Where a return is requested under a voluntary return policy rather than a statutory right, we may require the product to be returned in an appropriate condition, with its accessories and packaging where reasonably possible.
A voluntary return policy does not replace or reduce your statutory rights.
5. Incorrect, Missing or Damaged Deliveries
Please inspect your package as soon as reasonably possible after delivery.
If your order arrives:

Damaged;

With missing components;
-
With the wrong product; or
-
With an item that does not correspond with your order,
please contact us as soon as possible and provide your order number together with photographs of the package and product where appropriate.
We will investigate the issue and provide the appropriate remedy in accordance with applicable law.
Please retain the original packaging until the issue has been resolved, particularly where the courier or delivery service may need to inspect the package.
6. How to Request a Return
To request a return, please contact us using the contact details provided on our website.
Please provide:

Your full name;

Order number;

Date of purchase;

Product purchased;
-
Reason for the return;
-
Photographs or video of the product where relevant; and
-
Any other information reasonably required to process the return.
Do not send a product back to us without first contacting us and receiving return instructions.
This helps us ensure that your return is sent to the correct address and can be properly identified and processed.
7. Return Inspection
Returned products may be inspected to determine the nature and cause of the reported issue.
An inspection does not automatically mean that a return, repair, replacement or refund will be refused.
Where a consumer is exercising a statutory right, our assessment will be conducted consistently with applicable South African consumer law.
If the problem is determined to have resulted from misuse, unauthorised modification, accidental damage or another cause for which we are not legally responsible, we will explain the outcome to the customer.
8. Refunds
Where a refund is legally required or otherwise approved under this policy, the refund will normally be made using the original payment method where reasonably possible.
The timing of a refund may depend on:

The applicable statutory requirements;

Completion of the return process;
-
Inspection where appropriate; and
-
Processing times of the relevant payment provider or financial institution.
Where a statutory deadline applies, we will comply with that deadline.
We will not use this policy to impose a refund deadline that is less favourable than a mandatory period prescribed by South African law.
9. Shipping Costs for Returns
The person responsible for return shipping costs depends on the reason for the return and the applicable law.
For example, where a product is validly returned because it is defective or otherwise falls within a statutory remedy, the applicable law may require the supplier to bear the relevant return costs.
For a voluntary change-of-mind return, the customer may be responsible for the direct cost of returning the product where permitted by law.
We will provide the applicable return instructions when your request is received.
10. Repairs and Replacements
Where a valid defect is covered by the applicable statutory warranty or an applicable manufacturer's warranty, we may repair or replace the product where permitted and appropriate.
Under section 56 of the CPA, where a product has been repaired and the relevant failure, defect or unsafe feature has not been remedied within the prescribed period, or a further failure, defect or unsafe feature is discovered within that period, further statutory remedies may apply, including replacement or refund.
Where a replacement is provided, the replacement will be subject to the rights and protections provided by applicable South African law.
11. Manufacturer's Warranty
Some PrepDrive products may include an additional manufacturer's or supplier's warranty.
Any additional warranty will operate alongside, and not instead of, the consumer's rights under South African law.
Where an additional warranty provides greater protection than the statutory minimum, the additional warranty will apply according to its stated terms.
12. Products Purchased on Sale or Promotion
Products purchased during a sale, promotion or special offer remain subject to applicable statutory consumer rights.
A discount or promotional price does not by itself remove a consumer's statutory rights relating to defective, unsafe or unsuitable goods.
Where a product was clearly sold in a particular condition and the consumer was expressly informed of that condition and knowingly accepted it, the applicable statutory rules concerning goods sold in that condition may apply.
13. No Unlawful Exclusion of Consumer Rights
Nothing in this Returns, Refunds & Warranty Policy is intended to:

Exclude a right granted to a consumer by applicable law;

Require a consumer to waive a statutory right;
-
Exclude liability where such exclusion is prohibited by law; or
-
Prevent a consumer from exercising a remedy available under South African consumer-protection legislation.
If any provision of this policy is found to be unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary to comply with applicable law, while the remaining provisions will continue to apply.
14. Fraudulent or Abusive Return Claims
We reserve the right to investigate suspected fraudulent, dishonest or abusive return claims.
This may include situations involving:

False claims that a product was defective;

Deliberate damage to a product;
-
Returning a different product from the one purchased;

Returning counterfeit or substituted goods;
-
Repeated dishonest claims; or
-
Providing materially false information about a return.
Nothing in this section affects a consumer's genuine statutory rights.
15. Consumer Protection
PrepDrive supports the rights and protections afforded to consumers under South African law.
Where a consumer has a valid statutory right to a repair, replacement, refund, cancellation or other remedy, we will deal with the request in accordance with the applicable legislation.
This policy should therefore be read together with the applicable provisions of the CPA, ECTA and other South African legislation.
